General Terms and Conditions of Sale

These terms and conditions govern the booking of tourist accommodation marketed through www.bbarcelonaapartments.com. Completing a booking implies express acceptance of these conditions.
Identification of the accommodation provider. The apartments marketed through this website belong to different owner companies. Balsells Zaragoza Gestio SL (Tax ID B61525275) manages the marketing and guest services on behalf of those owners. Before confirming each booking, the owner company of the reserved accommodation will be identified, as it will be the contracting party for the accommodation service:

Apartments in the Sagrada Familia Flats building (property 10): Balsag Project SL (Tax ID B65699852). C/ Provença 529, Baixos, 08025, Barcelona.
Apartments in the Gaudí Flats building (property 11): Cap a Puestu SL (Tax ID B64405251). C/ Brusi 39, 20, 08006, Barcelona.
All other apartments: Balsells Zaragoza Gestio SL (Tax ID B61525275).

Booking process. The booking is completed through the booking engine. Once finalised, the guest will receive an email confirmation with the accommodation details, dates, amount and the contracting owner company.
Payment. Payment for each booking is made directly through the payment gateway of the owner company of the reserved accommodation. The amount paid by the guest is received directly by the company owning the reserved apartment, and not through a single centralised account or gateway. Balsells Zaragoza Gestio SL invoices its management services separately to each owner company, without this affecting the price paid by the guest.
Prices and taxes. Prices include applicable taxes unless otherwise stated. The tourist tax of the Generalitat de Catalunya and the local municipality, where applicable, will be applied in accordance with current regulations.
Cancellation policy. The cancellation conditions applicable to each booking will be displayed during the booking process and will appear in the confirmation. Unless otherwise indicated, the conditions of the rate selected by the guest shall apply.
Security deposit. A security deposit or guarantee may be required to cover possible damages, which will be returned after check-out once the condition of the accommodation has been verified, in accordance with the conditions communicated at the time of booking.
Check-in and check-out. Check-in and check-out times will be communicated in the booking confirmation. The guest must respect the maximum number of occupants and the rules of use of the accommodation.
Traveller registration. In compliance with current regulations, the guest must provide identification details for all occupants for mandatory reporting to the competent authorities.
Liability. The owner company of the accommodation is responsible for the proper provision of the accommodation service. Balsells is responsible for the management and guest services it provides on behalf of the owner.
Applicable law. These conditions are governed by Spanish law and the applicable regional regulations on tourist accommodation.

Privacy Policy

In compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), the following information is provided regarding the processing of personal data submitted through this website.

In compliance with EMVCo, MasterCard, VISA regulations and the European PSD2 Directive, during the electronic payment process, information related to the connection used in the session will be communicated to the card-issuing Bank in order to validate the payment transaction carried out by the user.

Data Controller. The data controller varies depending on the purpose:

For the management of the website, contact forms, enquiries and commercial communications from "BBarcelona Apartments", the controller is Balsells Zaragoza Gestio SL (Tax ID B61525275), Calle Cartagena, 243 - PB, 08025 Barcelona, [email protected].
For data linked to a specific booking, the controller is the owner company of the reserved accommodation (Balsells Zaragoza Gestio SL, Balsag Project SL or Cap a Puestu SL, depending on the property), with Balsells Zaragoza Gestio SL acting as data processor on behalf of that owner.

Data Protection Roles. When a guest books accommodation owned by Balsag Project SL (Sagrada Familia Flats building, property 10) or Cap a Puestu SL (Gaudí Flats building, property 11), those companies act as data controllers in respect of the guest's personal data. Balsells Zaragoza Gestio SL processes such data solely as a data processor, exclusively to provide marketing, booking management and guest services on behalf of the owner, pursuant to a data processing agreement entered into under Article 28 of the GDPR. Balsells does not use guest data for its own purposes other than those instructed by the controller, unless the guest gives separate consent (e.g. to receive commercial communications from BBarcelona Apartments).
Purposes. To manage the relationship arising from the booking and the provision of accommodation services; to handle enquiries and requests; and, subject to consent, to send commercial and informational communications.
Legal Basis. Processing is lawful on the basis of: (i) the performance of the booking contract or pre-contractual measures; (ii) compliance with legal obligations (including, among others, the registration and reporting of travellers); and (iii) the data subject's consent for the sending of commercial communications.
Retention. Data will be retained for the duration of the relationship and, thereafter, for the periods required by law to address potential liabilities (in particular, tax retention periods and those arising from traveller registration regulations). Data processed on the basis of consent will be retained until such consent is withdrawn.
Recipients. Data may be disclosed to the competent authorities where required by law, and to service providers acting as data processors (including, among others, the booking management system provider and payment gateways), with whom the relevant agreements have been executed. No international transfers of data are made except those covered by adequate safeguards in accordance with the GDPR.
Rights. Data subjects may exercise their rights of access, rectification, erasure, objection, restriction of processing, portability and not to be subject to automated individual decision-making, by writing to Balsells Zaragoza Gestio SL, Calle Cartagena, 243 - PB, 08025 Barcelona, or by email to [email protected], with the subject line "DATA PROTECTION". Where the controller is the accommodation owner, Balsells will forward the request to that controller. Data subjects have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
Accuracy of Data. The data subject is responsible for the truthfulness and accuracy of the data provided and undertakes to notify any changes.
